1. About these terms

These terms cover your use of the 1AM app ("1AM", "we", "us") and its 1AM Premium subscriptions. By using 1AM, you agree to them. They apply in addition to Apple's Licensed Application End User License Agreement. If the two conflict, these terms apply where the law allows.

2. You must be 18 or older

1AM contains adult and romantic themes. You and anyone you play with must be at least 18 years old.

3. Play with consent

1AM is a game for two people who both want to play. Either of you can skip any card, at any time, for any reason. The 1AM and 3AM hours open only after both of you agree. Never use the app to pressure anyone.

1AM is entertainment. It isn't therapy, counselling, or medical, sexual-health or relationship advice.

4. 1AM Premium subscriptions

• Plans. 1AM Premium is offered as a weekly or yearly auto-renewing subscription. It unlocks every card in every game and hour. Prices are shown in the app before you buy and can vary by country.
• Billing. Payment is charged to your Apple ID when you confirm the purchase.
• Automatic renewal. Your subscription renews automatically at the same price and length unless you turn off auto-renew at least 24 hours before the end of the current period. Your Apple ID is charged within 24 hours before the period ends.
• Managing and cancelling. You can manage or cancel your subscription anytime in your Apple account settings (Settings › your name › Subscriptions). Cancelling stops the next renewal; you keep Premium until the current period ends.
• Free trials. If a free trial is offered, any unused part of it ends when you buy a subscription. If you don't cancel before the trial ends, the subscription starts and you're charged.
• Refunds. Apple handles all payments and refunds. You can request a refund at reportaproblem.apple.com.
• One phone, both of you. Premium is tied to the Apple ID that bought it and can be restored on that Apple ID's devices with "Restore purchases".

5. What you write

Names, stories and anything else you type stay on your phone. You're responsible for what you write, and you shouldn't use 1AM to create anything illegal or harmful.

6. Our content

The questions, dares, stories, design and logo in 1AM belong to us. You may use them for your own personal, non-commercial play. Please don't copy, resell or republish them.

7. No guarantees

We work hard to keep 1AM running well, but we provide it "as is" and can't promise it will always be available or free of errors. To the extent the law allows, we aren't liable for indirect or consequential losses arising from your use of 1AM, and our total liability is limited to the amount you paid for 1AM Premium in the 12 months before the claim. Nothing in these terms limits rights you have under consumer law that can't be excluded.

8. Changes

We may update the app, its content and these terms. If we make an important change to these terms, we'll update the date at the top of this page. Continuing to use 1AM after a change means you accept the new terms.

9. Apple

These terms are between you and us, not Apple. Apple isn't responsible for 1AM or its content, has no obligation to provide support or maintenance for it, and isn't responsible for any claims relating to it. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
